The ground rules for using KIHUTech apps and this website — written in plain English.
Accepting these terms
These Terms of Use form a binding agreement between you and Tran Hoai Hung (operating as KIHUTech), an independent developer based in Ho Chi Minh City, Vietnam. By downloading, installing, or using any KIHUTech app, or by using kihutech.com, you confirm you have read these terms, agree to them, and have the legal capacity to enter into this agreement. If you do not agree, do not use the services.
Eligibility and age
You must be at least 13 years old to use KIHUTech apps and this website. In jurisdictions where the minimum age for digital consent is higher (16 in some EU countries), the higher local age applies. If you are below the legal age of majority in your jurisdiction, you must have permission from a parent or legal guardian. Use of the services is prohibited where prohibited by local law.
Accounts and credentials
Some features may require an account. You are responsible for keeping your credentials confidential, for all activity that happens under your account, and for notifying support@kihutech.com immediately if you suspect unauthorized access. KIHUTech is not liable for losses caused by failure to keep credentials secure. You may close your account at any time by emailing the same address.
Licence to use
KIHUTech grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the apps on devices you own or control, for personal, non-commercial purposes. This licence does not transfer ownership and may be revoked if you breach these terms. On iOS and Android, the additional licence terms set by Apple App Store and Google Play also apply — see Third-party Stores below.
Your content
Content you create using the apps (tasks, notes, ideas, photos, puzzles, scores) belongs entirely to you. KIHUTech claims no ownership over your content. By using sync or backup features (where offered) you grant KIHUTech a limited licence solely to store, transmit, and display the content as required to operate the service. You can revoke this licence by deleting the content or your account at any time.
In-app purchases
Some apps may offer one-time in-app purchases (cosmetics, expansions, removing ads). Purchases are processed by Apple App Store or Google Play according to their billing policies. KIHUTech does not store payment card details. All purchases are subject to the platform's terms. Prices, availability, and content of paid items may change at any time without prior notice.
Subscriptions and auto-renewal
If an app offers a subscription, the following applies. Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the period ends. Cancellation must be done in your App Store or Google Play account settings — not from inside the app. The cost of renewal will be charged to the payment method on file with the store. You can review and manage subscriptions in your store account at any time.
Refunds
All purchases are final and non-refundable except where required by applicable law. Refund requests must be submitted to Apple App Store or Google Play directly — KIHUTech cannot issue refunds on behalf of the platforms. For users in the European Union and the United Kingdom, you may have a statutory right of withdrawal within 14 days for digital content; this right is forfeited once you start using the digital content, in line with EU Directive 2011/83/EU.
Third-party platforms
KIHUTech apps are distributed through Apple App Store and Google Play. Your use of an app is also governed by the relevant store's terms of service. Apple and Google are not parties to this agreement and are not responsible for the apps. However, Apple and Google are third-party beneficiaries of these terms with respect to the apps distributed through their stores and may enforce these terms against you. Embedded YouTube content is governed by YouTube's terms.
Prohibited use
You may not: (a) reverse-engineer, decompile, or disassemble the apps except as permitted by law, (b) use the apps to infringe intellectual property, harass, harm, or impersonate others, (c) probe, scan, or test the vulnerability of any KIHUTech system, (d) use the apps for unlawful or fraudulent activity, (e) attempt to bypass paywalls or restrictions, or (f) use automated means (bots, scrapers) to access the services without prior written consent.
Intellectual property
The apps, this website, their source code, design, artwork, trademarks (including the names KIHUTech, Bloom Survivors, Poppin, SnapFit, Missions, IdeaBox), text, sound, and any other content created by KIHUTech are the property of Tran Hoai Hung or his licensors and are protected by copyright, trademark, and other intellectual property laws of Vietnam and international treaties. Nothing in these terms transfers ownership of intellectual property to you.
Copyright complaints
If you believe content in a KIHUTech app or on kihutech.com infringes your copyright, send a notice to support@kihutech.com including: (1) identification of the copyrighted work, (2) identification of the infringing material and its location, (3) your contact information, (4) a statement that you have a good-faith belief the use is not authorized, (5) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner, (6) your physical or electronic signature. Counter-notices follow the same format.
Disclaimer of warranties
THE APPS AND WEBSITE ARE PROVIDED 'AS IS' AND 'AS AVAILABLE', WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. KIHUTech does not warrant that the services will meet your requirements, that defects will be corrected, or that the apps will be available at all times. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, some of the above exclusions may not apply to you.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIHUTech (Tran Hoai Hung) shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of the services. The total aggregate liability of KIHUTech shall not exceed the greater of: (a) the amount you paid to KIHUTech in the 12 months preceding the claim, or (b) USD 10. Some jurisdictions do not allow these limitations; in those jurisdictions, liability is limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Tran Hoai Hung (KIHUTech) and his affiliates, agents, and licensors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the services, (b) your violation of these terms, (c) your violation of any third-party right including intellectual property or privacy rights, or (d) any user content you submit.
Termination
You may stop using the services at any time and delete your account. KIHUTech may suspend or terminate your access immediately, without prior notice, if you breach these terms, abuse the services, or if required by law. Upon termination, the licence granted to you ends. Sections of these terms that by their nature should survive termination (Intellectual Property, Disclaimer, Limitation of Liability, Indemnification, Governing Law) shall survive.
Governing law and disputes
These terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law principles. Any dispute arising from or related to these terms or the services shall be resolved by the competent People's Court of Ho Chi Minh City, Vietnam, except where applicable consumer-protection law in your country of residence requires otherwise. Nothing in this clause limits any non-waivable rights you have under your local consumer-protection law.
Changes to these terms
These terms may be updated when the services change. Material changes will be announced in-app and by email at least 30 days before they take effect; continued use of the services after the effective date constitutes acceptance of the updated terms. Minor wording fixes will be posted here with a new 'Last updated' date. If you do not accept a material change, you must stop using the services before the effective date.
